If you are getting ready to set up a farm, you may want to contact an environmental attorney. An environmental attorney can provide you with the assistance you need to make sure that you are following all the rules and regulations that are in place. Here are a few different ways and area that an environmental law attorney can assist you.
#1 Water Rights
If you are setting up a farm, it is important to understand water rights. Just because a stream runs through your property or you have a pond located on your property does not meant that you have the legal rights to use that water. Water rights are very complex. Oftentimes, the water belongs to governing agencies and the water is to be used among various different parties. Other times, the water ways may be protected due to the wildlife that live in the water or use the water. Don't assume that you can just use natural sources of water on your property; make sure that you also have rights to it.
What you put into the water maters as well. If you have a water way running through your property, you are going to want to make sure that fertilizer and animal waste does not run into the water way. There may be legal rules and regulations that you have to follow in keeping the water that runs through your land clean as well when you have a farm operation set-up.
#2 Soil Usage
It may seem incredible, but the government can actually determine how you use the soil on your own property. The government wants to preserve land, and many farming practices can strip the nutrients out of the land. You may be required to rotate certain crops around in order to protect the land and ensure that it is not stripped of its nutrients. In some states, you even need to offset your farmland with additional wildlife land, especially if your farm is changing the environmental set-up.
If you plan on keeping livestock on your land for commercial purposes, you are going to need to apply for a confined animal operating permit from your state department of natural resources. There are also specific rules that you have to follow when it comes to providing food and space to livestock to live in, as well as lots of regulations around practices such as collecting and selling milk and eggs and using animals for meet.
An environmental attorney can help insure that you are aware of and following all environmental laws that apply to your new farm practice. They can also help you fill out and apply for the appropriate permits with the state and local government agencies that you are going to need to obtain in order to run your small farm operation for commercial gains.
